In these terms, "I" refers to Marko Haas, trading as MH-Content (registered Kleingewerbe, Germany), and "the client" refers to any individual or organisation booking my services. These terms govern photography and videography services provided by MH-Content and cannot be varied unless agreed in writing.
I provide photography and videography services for sports, events, personal branding, and brand content clients. The specific scope of any project — including shoot days, deliverables, turnaround, and usage rights — is agreed in writing in a project-specific quote before the shoot.
I do not shoot weddings or family portrait sessions. For these, I am happy to recommend other Cape Town photographers.
A project is confirmed once the client has accepted the written quote in writing (by email is sufficient) and any agreed booking fee has been paid.
For new clients or larger projects, I may request a booking fee of up to 50% of the total quote to confirm the shoot date. This booking fee is non-refundable in the event of cancellation by the client within the periods set out below. For established clients, I typically work on invoice without an upfront booking fee — this is agreed per project.
The remaining balance is due within seven days of final delivery unless otherwise agreed in writing. Payment terms, currency, and accepted methods are confirmed in the quote.
If the client cancels a confirmed booking, the following applies:
Where no booking fee has been paid (established-client arrangement), late cancellation may still incur a cancellation fee equivalent to costs already committed.
In the unlikely event I need to cancel a confirmed booking due to illness, injury, or other circumstances beyond my reasonable control, my liability is limited to a full refund of any fees paid. Where possible, I will help the client find a replacement photographer or videographer of similar standing.
If the client needs to reschedule, I will make reasonable efforts to accommodate. Rescheduling more than 14 days before the original shoot date is typically possible without additional fees. Rescheduling closer to the date may incur a rebooking fee depending on whether the original date can be filled.
Weather-dependent outdoor shoots may be rescheduled without fee if conditions make the shoot impossible — agreed on a case-by-case basis.
Photographs and video are taken at the photographer's discretion, with reasonable effort to comply with the client's brief and any specific requested shots. Specific shots, locations, or arrangements are not guaranteed — particularly where they depend on subject availability, weather, or venue restrictions.
At certain venues, the photographer's movement may be restricted by officials or venue staff. I cannot be responsible for obstructed views or missed shots in these circumstances.
Standard delivery turnaround is 7–14 days from the shoot date for full edits. Same-day social cuts are available for events where this has been agreed in advance.
Rush turnaround (under 7 days) is available for an additional fee, agreed before the shoot.
Delivery is via secure online gallery or file-sharing platform. Files are available for download for 30 days from delivery; backup access can be arranged on request.
Copyright in all photographs and video remains with the photographer (Marko Haas) under the German Copyright Act (UrhG). Unless otherwise specified in the project quote, the client receives a non-exclusive, worldwide, unlimited-duration licence to use the delivered files for their stated commercial or personal purpose.
Exclusive licences, paid media usage rights, and broadcast rights are available on request and are priced separately.
The photographer retains the right to use delivered work in his own portfolio, on his website, and in marketing materials, unless explicitly restricted in writing in the project agreement.
Raw files and unedited image/video files are not delivered as part of standard projects and remain the property of the photographer. Raw file delivery may be agreed separately for an additional fee.
While all equipment is checked and maintained, and reasonable backup is in place, the photographer is not liable for images or footage lost due to technical failure beyond reasonable control. In such cases, liability is limited to a refund of fees attributable to the affected portion of the shoot.
Any directions given to clients, guests, models, or employees during a shoot are followed at the participant's own risk. The photographer is not responsible for personal injury arising during a shoot.
Neither party is liable for failure to perform under these terms where prevented by circumstances beyond reasonable control — including illness, injury, severe weather, transport disruption, or governmental restrictions. In such cases, the parties will make reasonable efforts to reschedule or refund fees as appropriate.
These terms are governed by German law. Any disputes that cannot be resolved by direct discussion will be subject to the jurisdiction of the courts of Germany, save where consumer protection law requires otherwise.
I may update these terms from time to time. The version applicable to any project is the version published at the time the project is confirmed.
